By visiting our site, browsing our store, placing an order, or otherwise using our services, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, and Returns & Refunds Policy.

Some products may be pre-order, made to order, signed, final sale, or otherwise subject to special conditions explained on the product page or in a separate policy. We may update product descriptions, discontinue products, or limit quantities at any time without notice.
3. Orders
When you place an order, you are making an offer to purchase the items in your cart. Your order is not accepted until we confirm it, usually by order confirmation or dispatch communication. We may refuse, cancel, or limit an order at our discretion, including where stock is unavailable, payment cannot be processed, or we suspect fraud, abuse, or an error in the order.
Please review your order carefully before submitting it. Once an order has been accepted or processed, cancellation may not be possible, especially for items that are already packed, dispatched, pre-ordered, signed, or made to order.
Your purchases are subject to our Returns & Refunds Policy, which forms part of these Terms. Nothing in these Terms excludes or limits your rights under Australian Consumer Law.
4. Prices and billing
Prices, discounts, and promotions may change at any time without notice. The price payable for an item is the price displayed at checkout when you place your order, unless there has been a clear error. Shipping charges, where applicable, are shown separately at checkout in accordance with our Shipping Policy.
You agree to provide current, complete, and accurate billing and payment information for all purchases. You authorise us, and our third-party payment providers, to charge your selected payment method for the total amount of your order, including product costs, shipping, taxes, and any other amounts clearly disclosed at checkout.
If payment cannot be processed, your order may be delayed, refused, or cancelled. We may also hold or cancel orders where payment information appears incorrect, incomplete, or suspicious.
5. Shipping and delivery
Shipping methods, rates, handling times, and delivery terms are set out in our Shipping Policy, which forms part of these Terms. Delivery timeframes are estimates only and may be affected by Australia Post, weather events, peak periods, or other circumstances outside our control.
You are responsible for ensuring that the shipping address entered at checkout is accurate and complete. We are not responsible for losses arising from incorrect or incomplete delivery details provided by the customer.
Nothing in this section limits your rights under Australian Consumer Law if an item is lost, damaged, delayed, or not delivered, as required by law.
6. Returns and refunds
Returns, refunds, and exchanges are governed by our Returns & Refunds Policy, which forms part of these Terms. We do not offer change-of-mind returns or exchanges unless required by law. If an item is faulty, damaged, unsafe, not as described, or otherwise fails to meet consumer guarantees, you may be entitled to a remedy under Australian Consumer Law.
If you need to request a return or refund, please follow the process in that policy. We may ask for photos, order details, or other supporting information so we can assess the issue properly. We may also request that items be returned in original condition and packaging, where reasonably possible.
7. Chargebacks and Dispute Resolution
If you have a concern about your order, please contact us first so we can review the issue and work toward a fair resolution. We are committed to resolving genuine faults, damage, delivery issues, or other concerns as quickly as possible.
If a chargeback is initiated without first giving us a reasonable opportunity to investigate and resolve the matter, this may delay our ability to assist and may be taken into account when reviewing future ordering activity on the account. We reserve the right to refuse or cancel future orders where there is evidence of fraudulent activity, repeated abusive behaviour, or misuse of the chargeback process.
Nothing in this section prevents you from exercising your rights under Australian Consumer Law or through your financial institution where appropriate.

Unless we expressly agree otherwise, products purchased from our store are for personal, household, or gift use only and are not for commercial resale or export. We may refuse orders we reasonably believe are intended for resale or unauthorised commercial use.

11. Shopify Relationship
Our store is powered by Shopify, which provides the platform that allows us to offer our services. However, any sale you make through our store is directly with Once Upon a Bookshop. Shopify is not responsible for any product purchased from us, and you agree not to hold Shopify liable for issues arising from your purchase to the extent permitted by law.
12. User Feedback
If you send us reviews, feedback, suggestions, or other content, you give us permission to use that content to improve and promote our business, unless you tell us otherwise and we agree. You must only send content that you have the right to share and that does not breach any law or anyone else’s rights.

We may suspend, restrict, or terminate access to the services, or refuse future orders, if we reasonably believe you have breached these Terms, engaged in fraud, misused the chargeback process, or acted in a way that is abusive, threatening, or harmful to our business or other customers.
Any outstanding amounts owed to us remain payable. Sections of these Terms that by their nature should continue to apply after termination will remain in force.
16. Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot be excluded. Where the law applies, our goods come with guarantees that cannot be excluded.
To the extent permitted by law, and subject to your consumer rights, we do not make guarantees beyond those expressly stated on our website or in our policies.

These Terms, together with our Privacy Policy, Shipping Policy, and Returns & Refunds Policy, make up the full agreement between you and us regarding your use of the website and purchase of our products.

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer our rights and obligations under these Terms where necessary, including in connection with the sale or restructuring of our business.
22. Governing Law
These Terms are governed by and construed in accordance with the laws in force in South Australia and the Commonwealth of Australia. You and Once Upon a Bookshop submit to the non-exclusive jurisdiction of the courts of South Australia and the Commonwealth of Australia.
